A conservative law firm is asking a judge to strike downGov. Tony Evers' extension of the statewide mask mandate. Since attorneys for the Wisconsin Institute for Law and Liberty filed the request, state Republican leadersfiled a briefin support of the lawsuit on behalf of the state Legislature.
All this, despite Wisconsin experiencing a surge in cases of COVID-19 throughout the state, especially now in rural areas that previously reported few positive cases.
"I'm not saying that they shouldn't wear them. We are saying that if the governor wants to order people to wear them then the governor and the legislature have to proceed in the right way," says Rick Esenberg, the president and general counsel of the firm filing the suit.
Esenberg says his reason behind filing the lawsuit is to put a check on and limit the governor of Wisconsin's executive power. A hearing in the case is scheduled for Monday in Polk County Circuit Court.
