State Appeals Court Upholds Photo ID Requirement

Wisconsin's 4th District Court of Appeals has ruled that the state's photo identification requirement for voters, is constitutional.

Thursday's decision reverses a lower court ruling that struck down the rule, believing it would infringe on citizens' right to vote.

The Republican-controlled Legislature approved the photo ID requirement in 2011. Afterward, the League of Women Voters filed suit against the measure in Dane County Circuit Court and won a decision from Judge Richard Niess.

According to appeals court, the League failed to prove that the requirement is unconstitutional.

Other suits against the law are pending. They include two challenges in federal court and another in state court. In that case, a Dane County judge blocked the photo ID requirement, so it has not yet been enforced during elections in Wisconsin.
