John Doe Update: Wisconsin Club for Growth Sues State Elections Agency

The suit claims the Government Accountability Board has illegally been helping investigate "virtually every conservative-leaning group in Wisconsin."

The Club and its leader Eric O'Keefe filed the lawsuit Friday in Waukesha County Circuit Court. They also contend that the GAB has violated their free speech rights. Named along in the suit with the GAB is its director, Kevin Kennedy.

Among the demands the suit makes are that the court prohibit the GAB from assisting in John Doe II and any future John Doe proceedings.

John Doe II has reportedly been exploring whether there were illegal ties between Gov. Walker's 2012 recall campaign and conservative funders. Laws prevent coordination between the two.

The Club is already suing the prosecutors involved in the probe claiming they are targeting conservative groups and violating their free speech rights, and the group won the first round in federal court. U.S. District Judge Rudolph Randa ordered investigators to halt their probe and destroy all evidence collected. A federal appeals court halted the latter part of Randa's order and is still considering the former.

The suit filed Friday in Waukesha contends the GAB and Kennedy, by assisting investigators, are exceeding the agency's statutory authority and spending taxpayer resources without being authorized to do so.

There is no response from Kennedy or GAB staff.
